These Terms & Conditions (“Terms”) govern your access to and use of our Site and any purchase you make through the Site. By using the Site or placing an order, you agree to these Terms.
If you do not agree, do not use the Site.
1) Eligibility & Accounts
You must be at least 18 years old (or the age of majority in your location) to make a purchase.
If you create an account, you agree to provide accurate information and keep your login credentials confidential. You’re responsible for all activity under your account.
2) Orders, Pricing & Payment
Order Acceptance
Your order is an offer to buy. We may accept, reject, or cancel an order for any reason, including suspected fraud, product availability issues, errors, or misuse of promotions.
Pricing & Errors
Prices are shown in USD unless stated otherwise. We may change prices at any time. If a pricing or product description error occurs, we may cancel the order and refund you.
Taxes
Sales tax may be collected where required.
Payment
We accept payments through [Shopify Payments/Stripe/PayPal/etc.]. By submitting payment, you represent you’re authorized to use the payment method.
3) Shipping, Delivery & Risk of Loss
Shipping options, costs, and estimated delivery times are presented at checkout.
Risk of loss and title pass to you upon delivery to the carrier (unless applicable law provides otherwise). We are not responsible for delays caused by the carrier, weather, or events outside our control.
If your package arrives damaged, contact us at cablerated@cablerated.com and include photos of:

the damaged product,

the shipping box, and
-
packing materials.
4) Returns, Refunds & Restocking Fees
Returns and refunds are governed by our Warranty & Returns Policy, which is incorporated into these Terms by reference.

Merchandise has a 30-day return window only for manufacturing defects or shipping damage.

Other returns, if accepted, incur a 30% restocking fee and you pay return shipping.

5) Limited Lifetime Warranty (Cables)
Cable products may be covered by our Limited Lifetime Warranty when used under normal conditions and to spec, as described in our Warranty & Returns Policy, incorporated by reference.

6) Product Use & Safety
You agree to use products safely and as intended. Some products (e.g., cables) may be sensitive to improper use (excessive bending, pulling by connectors, exposure to liquids, etc.). CableRated is not responsible for damage caused by misuse or use outside product specifications.
7) Intellectual Property
The Site and all content (including logos, designs, text, graphics, photos, videos, product names, and trademarks) are owned by CableRated or its licensors and are protected by intellectual property laws.
You may view and use the Site for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, sell, or exploit any content without our prior written consent.
8) User Content (Reviews, Comments, Submissions)
If you submit content (reviews, photos, feedback, etc.), you represent you have the rights to submit it and it does not violate law or third-party rights.
You grant CableRated a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, and display that content in any media for business purposes (e.g., marketing, product pages), unless prohibited by law.
We may remove content at our discretion.
9) Prohibited Uses
You agree not to:

violate any law or regulation;

infringe intellectual property rights;

submit false or misleading information;

attempt to gain unauthorized access to the Site or systems;

disrupt the Site (malware, scraping, denial-of-service, etc.);

use the Site to harass, abuse, or harm others.
10) Promotions, Gift Cards, and Discount Codes (Optional)
Promotions may be modified or cancelled at any time. Discount codes cannot be redeemed for cash and may have eligibility limits. If you offer gift cards, add: gift cards are non-refundable except as required by law.
11) Third-Party Links
The Site may contain links to third-party websites. We don’t control and aren’t responsible for third-party content, policies, or practices.
12) Disclaimer of Warranties (Site)
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, CABLEATED DISCLAIMS ALL WARRANTIES REGARDING THE SITE, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CABLEATED WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR LOST DATA) ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.
OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
WYOMING NOTICE: LIMITATIONS OF DAMAGES FOR PERSONAL INJURY CAUSED BY CONSUMER GOODS MAY BE LIMITED BY LAW AND MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED.
14) Indemnification
You agree to indemnify and hold harmless CableRated and its owners, employees, contractors, and agents from any claims, liabilities, damages, and expenses (including attorneys’ fees) arising out of your misuse of the Site, violation of these Terms, or infringement of rights.
15) Governing Law & Venue (Wyoming)
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules.
You agree that any dispute not subject to arbitration (if you add an arbitration section) will be brought exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there.
16) Changes to These Terms
We may update these Terms from time to time. The “Effective Date” indicates when they were last revised. Continued use of the Site after changes means you accept the updated Terms.
17) Severability & Entire Agreement
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and the policies referenced (including the Warranty & Returns Policy and Privacy Policy) are the entire agreement between you and CableRated regarding the Site.
